Global Bans for legit players?

Nope, not really.

Consenting to a search is not exactly the same as agreeing to terms and condition's, now is it?

A better example is the Steam EULA which stated that you could not resell your games, well the Court of Justice of the European Union found that they can, so law > contract at least in the EU.

Not really. Like in America we have a law protecting us from "unlawful search and seizure". But if you consent to the search...you can't later say you were illegally searched.

When you installed BE....you agreed to their terms and conditions. End of story.. It sucks yes.....but end of story

BE is a germany company, so their are bound to the german law. much companies have terms and conditions that not compatible with the law.

The last big thing in germany was EA with origin, they used the same terms and conditions from the US for Germany, but the law is different, and EA got a big punch in the face ^^

When BE says no you dont get the information, you can go to a lawyer who writes one of threi "special" letters, that they must answer the questions or their got sued.

All I can say is no one that I know legitimately playing the game has been banned. Considering how many people cant even be honest when they say "friendly" in this game leaves very little confidence for anyone to believe a banned player did not deserve it for one reason or another. Maybe you were banned for duping?

We dont know why we are got banned.

The only thing we know is, that we got banned after installing 95777.

Next thing: we got banned, unbanned, banned again, unbanned again, an so on.

So you can see its a BE problem.

The next time iam able to play, i will fraps it, so we will got it on tape what happens

Law...in US and Europe works on a system of precedent. Meaning Laws are not set in stone. You statement "law is greater then contract" Is not a true statement because it is for a court to decide on a case by case basis. I would imagine conflicts could occur when a company is based in one country and providing a service to someone in another country. Which countries laws take precedent? I imagine in such cases it goes to an international court to decide.

All I did was ask if the German law would stand even if a waiver had been signed. Your statement (law>contract) is not always true. Even if you can cite cases where it was. I can also cite cases where it wasn't. Lets stick to truths and not draw false conclusions.

BattlEye ban regarding of the GUID and Hackers / Cheaters have found a way to spoof it, WHAT CAN YOU SAY about people getting banned when they haven't play the game for weeks ?

This thread has now became full circle, we're starting from the beginning "oh gawd lol you got banned you cheated you hacked you deserved it"

Edit: And anyway BE being a German company I'm sure drew their terms and condtitions under German law. I'd be surprised if you could force them to give them all that info.

The BattlEye saw this afternoon there was a scam somewhere so they decided to unban mostly everyone. But the hack is still going, so people still get banned. It's just a matter of time.

Have you guys ordered the game from the Bohemia Shop or from the Steam shop ?

Is the GUID part of BattlEye or ArmA engine ?

BE can permanently or temporarily ban players from your server. The advantage over ArmA 2's PID banning is that the BE GUID cannot be hacked/changed client-side, therefore the only way for a player to get unbanned is to buy a new game/cd-key.

just if the the law is not clear, but in this case it is.

Because BE is a german companie the german law counts not the us, russian or whatever ^^

And for your first question, the US law does not count in germany, only the german law. The US dont rule everything ;)

Who even knows with battleye?

Their website looks like something from 1997, so I really find it hard to believe a company that can't even code some html to 21st century standards can be 100% right with their cheat detection.

Its part of Battleye, It just generates this code per Arma 2 OA CD key. I will check if they unbanned me now never again on 95777, I'm still on 95417 now.

But when an issue of contractual law comes up that is contained withing a single jurisdiction. It's up to the court to decide which takes precedent (at least i think in Europe and USA) It's not just as simple as saying law trumps contract. Sometimes maybe it is...but not always.

And being that BE is in Germany...I'll assume their EULA is drawn under German law by people who are very familiar with such. And I'd be surprised if it was actually illegal. I could be wrong.

When you look at the Website from BE i think they dont really have an EULA ^^ really their website is 1990 style.

Just a note on those saying "I KNOW this person would never hack" and so on.

A friend of mine in our CoD clan, had been for a long time, spoke to and played with them on a daily basis, for about 2 years, Got Vac banned, of course he said he didn't do it and so on, and we believed him, even stuck up for him, until we went back and reviewed the games (theater), he had been lying all that time, cheating, and still when presented with the VIDEO evidence denied it, still denies it to this day. (we expelled him from the clan / banned from all our servers).

So don't be so sure when your "friend" who would "never hack" is banned . . .

I had a game last night, all fine, latest patches (I used six to update). So i don't know.

That's my hypothesis, the dev team sees something wrong is going on, unban everyone who got banned but doesn't fix the problem at its source, so people keep getting banned.

To all of you saying those banned are hackers, I hope you log in on the latest patch and get hit with the same problem some p layers and facing. Personally, I am going to stay off the game for a couple of days because this did happen to a friend I play with daily. When I read your responses, the only thought I have is "why would he choose to hack AFTER we just walked 7km back to Stary to put stuff in our tents and go to bed? Wouldn't he hack while we camping electro for 4+ hours?"...Seems rediculous to me but hey most of you people don't like to give people the benefit of the doubt.

There are hackers all over this game and that is a known fact. I have a feeling BE was trying to improve their system because of all the bad PR lately, and the result was a small but growing group of legitimate players getting banned in the process.

Battleeye Random Fact: At least 10,001 players have been banned now since 2009 out of millions of people who bought your game. At least 1 of those players may be innocent, but who cares because admitting you've done something wrong will only hurt your company more in the short run. Just know I am never going to make the mistake of buying a game with your product again unless this is resolved.

TLDR: People hurt by hackers don't care how many innocent people are caught up in this until they are one of the victims of BE.

I just decided to buy the game again seeing as I don't think that BE will be responding anytime soon... If I get banned again I'll let you guys know.
