I am looking for the topic in which Rocket said - It's a ban if you spawn items into a server but not a ban if you pick them up and use them.

same, seen a dude on omnikai's stream who hacked and someone in chat said it was legit to pick up and not get banned for......

If you keep finding hacked items it will look suspicious, for all they know you have a second character who uses the cheats or a friend who does it.

Avoid using hacked items, they are not in the game for a reason. If you happen to find and use one without knowing then you should be ok.
