remember a name is not proof. I can call my server "Free kisses on join" It doesnt mean Im gonna.

As someone else suggested, the server name alone cannot be an accurate account for reporting. Usually I will go off what the MOTD says. If the MOTD (Which is typed by the server admin) has "No kill policys" or "Private server" rules I report them accordingly.
