Overlay ban's?

I saw some Topics

where some Guys asked why they are banned by Battleye because using an Overlay

 

could i get banned by Battleye using this new TS3 thing ( Overwolf ) ?

that has a Overlay too  :huh:

I use the Default TS3 overlay and its just fine. Have had it for about 4-5 months now with no problems. I don't know about other ones though. Back last year there where reports of people getting banned for overlays but I don't think the problem exists any more. (might be wrong though, can someone confirm?)
