Kicked by battleye

Hi there, my problem is when I join a server, after character creation if I hit "Escape" at any point while playing I am kicked by Battleye. It says something along the lines of "Kicked by battleye, etc etc reason #89". It is irritating. I have tried updating battleye but the problem persists.

I'm having the same issue started randomly today after a server glitched out and started kicking for Refuel script. (#44 which confused us) after about 8 kicks it started doing it for #115 for me only. I realised after awhile its due to pressing ESC.
