A friend of mine came upon a hacker while streaming, the hacker had spawned in a gun that cannot usually be found in DayZ. My friend killed the hacker and took his gun. Is this punishable?

This was just more to settle a dispute between viewers, he dropped the gun the second someone told him it was hacked.
