Are server owners allowed to make private servers?

I've seen quite a few of these servers that say "JOIN=KICK NO JOIN THIS SERVER THANKS" and I see people inside them.. and those servers are part of the main hive.. its like the server owners just have a private place without dangers to collect loot and then go off to another server with full gear.. is this allowed? one of those is this one : 94.23.8.173:2402

u have to report them directly to the gameserverhoster, read this:
